1. Acceptance of Terms
By downloading, installing, opening, or using the NutriNex mobile application ("App"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User", "you", "your") and ICT-Worx ("we", "us", "our", "NutriNex").

2. Description of Service
NutriNex is a mobile application that helps users with:
- Tracking food intake and calories
- Analyzing nutritional values via AI technology
- Generating personalized nutrition plans
- Tracking progress and goals
- Receiving nutrition advice via an AI assistant
The App is available for iOS devices via the Apple App Store.
3. Account and Registration
3.1 Account Requirements
To use the App, you must:
- Have an Apple ID
- Be at least 13 years old (or 16 years in the EEA, depending on local legislation)
- Have parental or guardian consent if you are between 13-16 years old (in the EEA)
3.2 Apple Sign In
The App uses Apple Sign In for authentication. By using Apple Sign In:
- You agree to Apple's Terms of Service
- You consent to sharing certain information with NutriNex (as described in our Privacy Policy)
- You are responsible for the security of your Apple ID
3.3 Account Responsibilities
You are responsible for:
- Securing your account and device
- All activities that occur under your account
- Providing accurate and current information
- Immediately reporting unauthorized access to your account
We are not liable for loss or damage resulting from unauthorized access to your account.
4. Use of Service
4.1 Permitted Use
You may use the App for:
- Personal, non-commercial use
- Tracking your own food intake and health goals
- Receiving nutrition advice and information
4.2 Prohibited Use
You may NOT use the App to:
- Engage in illegal activities
- Violate the rights of others
- Distribute malware, viruses, or harmful code
- Reverse engineer, decompile, or disassemble the App
- Use automated systems (bots, scripts) to access the App
- Copy, modify, or distribute the App without permission
- Commercial purposes without our written consent
- Harass, threaten, or mislead other users
- Provide false or misleading information
4.3 AI-Generated Content
The App uses AI technology (OpenAI) to analyze nutritional information and provide advice. You understand and accept that:
- AI analysis may not be 100% accurate
- Nutritional values are estimates, not exact measurements
- You should always use your own judgment when making nutrition decisions
- We are not liable for decisions based on AI advice
5. Subscriptions and Payments
5.1 Premium Subscriptions
NutriNex offers premium subscriptions with additional features:
- Basic Subscription: Limited food scans and AI chat
- Premium Subscription: Unlimited food scans and AI chat, additional features
Subscriptions are available as:
- Monthly subscription
- Annual subscription
5.2 Payments
- All payments are processed by Apple via the App Store
- Payments are made through your Apple ID account
- We do not process credit card data or other payment information
- Prices are displayed in the local currency of your App Store region
5.3 Auto-Renewal
- Subscriptions automatically renew at the end of each period
- You will be notified 24 hours before renewal
- Payment will be automatically charged to your Apple ID account
- You can disable auto-renewal at any time via:
- iOS Settings > [Your Name] > Subscriptions > NutriNex
5.4 Cancellation
You can cancel your subscription:
- Via iOS Settings > [Your Name] > Subscriptions > NutriNex > Cancel
- Cancellation is effective immediately at the end of the current billing period
- You retain access to premium features until the end of the billing period
- No refund for unused time in the current period (unless legally required)
5.5 Refunds
- Refunds are processed by Apple according to Apple's refund policy
- For refund requests, contact Apple Support
- We cannot process refunds directly
- In certain cases (e.g., technical issues), we may request refunds from Apple
5.6 Price Changes
- We reserve the right to change prices
- Price changes will be communicated to you at least 30 days in advance
- If you do not agree with price changes, you may cancel your subscription
- Price changes do not apply to existing subscriptions until the next renewal period
5.7 Free Trial
- We may offer free trials for new users
- Trials automatically convert to paid subscriptions unless you cancel
- You can cancel the trial at any time without charge
- After cancellation, you immediately lose access to premium features
6. Intellectual Property
6.1 Our Rights
All rights, titles, and interests in and to the App, including but not limited to:
- Software code
- Design and interface
- Logos, trademarks, and trade names
- Documentation
- AI models and algorithms
are owned by ICT-Worx or our licensors and are protected by copyright, trademark, and other intellectual property laws.
6.2 Your Rights
- You receive a limited, non-exclusive, non-transferable license to use the App for personal purposes
- This license may be terminated at any time
- You may not copy, modify, distribute, or sell the App
6.3 User Content
- You retain all rights to content you post in the App (photos, notes, etc.)
- By uploading content, you grant us a license to use it for providing the service
- You guarantee that you have the rights to share this content
7. Liability and Disclaimer
7.1 No Medical Advice
IMPORTANT: The App does NOT provide medical advice, diagnosis, or treatment. The App is:
- A tool for nutrition and calorie tracking
- NOT a substitute for professional medical advice
- Not intended for medical diagnoses or treatments
Always consult a qualified healthcare provider for:
- Medical advice
- Diet advice for medical conditions
- Nutrition advice for specific health problems
- Questions about medication interactions
7.2 No Warranties
The App is provided "as is" without warranties of any kind, express or implied, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Accuracy of nutritional information
- Uninterrupted or error-free operation
- Correction of defects
7.3 Limitation of Liability
To the extent permitted by law:
- We are not liable for indirect, incidental, special, or consequential damages
- Our total liability is limited to the amount you paid for the App in the past 12 months
- We are not liable for:
- Loss of data
- Loss of profits or income
- Loss of business opportunities
- Damage resulting from use or inability to use the App
7.4 Exceptions
These limitations do not apply to:
- Death or injury resulting from our negligence
- Intentional breach or gross negligence
- Damage caused by breach of essential contractual obligations
8. Availability and Maintenance
8.1 Service Availability
- We strive to keep the App available 24/7, but cannot guarantee this
- The App may be temporarily unavailable due to:
- Maintenance and updates
- Technical issues
- Force majeure
- Security updates
8.2 Updates
- We may regularly update the App to:
- Fix bugs
- Add new features
- Improve security
- Optimize performance
- Updates may be installed automatically
- You can disable automatic updates via App Store settings
8.3 Service Termination
We reserve the right to:
- Terminate the App or service at any time
- Modify or remove features
- Terminate your access for violation of these Terms

9.1 Termination by You
You can terminate your account at any time by:

- You will lose access to all features
- We cannot restore data

We may terminate your account or restrict your access if you:
- Violate these Terms
- Engage in illegal activities
- Harass or mislead other users

- Violate our intellectual property rights
9.3 Consequences of Termination
After termination:
- You immediately lose access to the App
- All active subscriptions are canceled (no refund)
- Your data will be deleted according to our Privacy Policy

Your privacy is important to us. Our use of your personal data is described in our Privacy Policy, which forms part of these Terms.
By using the App, you agree to:
- The collection, use, and sharing of data as described in our Privacy Policy
- Our compliance with the General Data Protection Regulation (GDPR)

11. Apple-Specific Terms
11.1 App Store
- The App is available via the Apple App Store
- By downloading the App, you agree to Apple's App Store Terms of Service
- Apple is not responsible for the App or its content
- Apple does not provide support for the App
11.2 In-App Purchases
- In-app purchases are processed by Apple
- Payments are made through your Apple ID
- Refunds are processed by Apple according to Apple's policy
- We cannot process refunds directly
11.3 Apple Sign In
- The App uses Apple Sign In for authentication
- By using Apple Sign In, you agree to Apple's terms
- Apple is responsible for the security of Apple Sign In
12. Changes to Terms
We may update these Terms from time to time. When we make significant changes:
- We will notify you via the App or by email
- We will update the "Last Updated" date
- We will ask you to accept the updated Terms
Your continued use of the App after changes means you accept the updated Terms.
If you do not agree with changes, you must stop using the App and delete your account.
13. Dispute Resolution
13.1 Applicable Law
These Terms are governed by and interpreted in accordance with Dutch law.
13.2 Disputes
In case of a dispute:

- Mediation: If we cannot resolve it, we may consider using mediation
- Court: If mediation does not work, disputes will be submitted to the competent court in Belgium
13.3 Class Action Waiver
To the extent permitted by law, you agree that disputes will be resolved individually and not as part of a class action.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.
14.2 Severability
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.
14.3 No Waiver
Our failure to act or exercise a right does not constitute a waiver of that right.
14.4 Assignment
You may not assign these Terms or your rights hereunder without our written consent. We may assign these Terms or our rights without your consent.
14.5 Force Majeure
We are not liable for failure to fulfill obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, strikes, or technical failures.

16. Acceptance
By downloading, installing, or using the App, you confirm that:

- You agree to these Terms
- You are of legal age to enter into this agreement
- You have obtained parental or guardian consent if required
If you do not agree to these Terms, do not use the App.
