• The NutriNex mobile application for iOS ("App")
• All related services, features, and content provided by ICT-Worx BVBA ("we," "us," or "our")

8.1 App Store Terms

Your use of the NutriNex iOS app is also subject to the Apple App Store Terms and Conditions. In case of conflict, Apple's terms take precedence for app-related matters.

8.2 App Permissions

The NutriNex app may request access to:

• Camera for food photo capture
• Photo library for image selection
• Apple Health for data synchronization
• Notifications for reminders and updates

You may revoke these permissions at any time through your device settings.

8.3 Updates and Compatibility

We grant you a limited, non-exclusive, non-transferable license to use NutriNex for personal purposes in accordance with these Terms.

11. Payment and Subscriptions

11.1 Free and Premium Services

NutriNex offers both free and premium subscription features:

• Free tier includes basic AI food recognition and nutrition tracking
• Premium subscriptions provide access to advanced features and enhanced functionality
• Subscription details and pricing are available within the iOS app

11.2 Apple Subscription System

All paid subscriptions are processed through Apple's App Store subscription system:

• Subscriptions are managed through your Apple ID account
• Payment is processed by Apple according to their terms and conditions
• Subscription management, including cancellation, is handled through your iOS device settings or App Store account
• Pricing is set in your local currency as determined by the App Store

11.3 Subscription Terms

By purchasing a subscription, you agree that:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your iOS device Settings or App Store account settings
• No cancellation of the current subscription is allowed during active subscription period

11.4 Refunds and Billing

Refund and billing policies are governed by Apple's App Store policies:

• All billing inquiries should be directed to Apple Support
• Refund requests must be made through Apple's App Store refund process
• We do not have access to or control over Apple's billing and refund systems
• Subscription features remain available until the end of the current billing period, even after cancellation

12. Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. Our services may be temporarily unavailable due to:

• Scheduled maintenance
• Technical difficulties
• Third-party service outages
• Force majeure events

We will attempt to provide advance notice of planned maintenance when possible.

13. Limitation of Liability

To the maximum extent permitted by law:

• ICT-Worx BVBA shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount paid by you for our services in the 12 months preceding the claim
• We provide services "as is" without warranties of any kind
• We do not warrant the accuracy of nutritional information or AI recommendations

14. Indemnification

You agree to indemnify and hold harmless ICT-Worx BVBA from any claims, damages, or expenses arising from:

• Your use of NutriNex services
• Your violation of these Terms
• Your violation of any rights of others
• Any content you submit or share through our services

15. Termination

15.1 Termination by You

You may stop using our services at any time and delete your account through the app settings or by contacting support.

15.2 Termination by Us

We may suspend or terminate your access if you violate these Terms or engage in prohibited activities. We will provide reasonable notice when possible.

15.3 Effect of Termination

Upon termination, your right to use NutriNex ceases immediately. We may retain certain data as required by law or legitimate business interests.

16. Changes to Terms

We may modify these Terms from time to time. We will:

• Notify users of material changes via email or app notification
• Post updated Terms with a new effective date
• Provide reasonable time to review changes before they take effect

Continued use of our services after changes constitutes acceptance of the new Terms.

17. Governing Law and Disputes

These Terms are governed by Belgian law, without regard to conflict of law principles.

17.2 Dispute Resolution

Any disputes arising from these Terms or your use of NutriNex shall be resolved through:

3. Binding arbitration under Belgian arbitration rules

17.3 Jurisdiction

For any legal proceedings, the courts of Ieper, Belgium shall have exclusive jurisdiction.

18. Miscellaneous

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the complete agreement between you and ICT-Worx BVBA regarding NutriNex services.

18.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

18.3 Waiver

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

18.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.
